Denaturalization of the separation of functions in the COA: Impact of the competency model of the Police Intendencies on the objectivity of the sanctioning procedure

Abstract

The research addressed the distortion of the principle of separation of functions in the administrative sanctioning procedure of the Police Intendencies in Ecuador, where the accumulation of operational and decision-making roles compromised objective impartiality. The general objective of the study was to analyze the impact of the competency model of these entities on procedural objectivity in order to determine the breach of the guarantees provided for in the Organic Administrative Code. A qualitative methodology of a dogmatic nature was applied with an analytical-deductive approach, which used the exegetical method for the normative examination and comparative analysis of the jurisprudence of the Constitutional Court. The results showed that the direct intervention of the Intendant in the control operations generated a procedural contamination that annulled the neutrality of the judge and transformed the procedure into an inquisitorial structure. It was identified that this functional confusion constituted a vice of absolute nullity by contravening the constitutional right to an impartial judge and legal certainty. The work concluded that the current organizational structure of the Intendencies was incompatible with the guarantee design of modern administrative law, which is why a reform that ensures the total division between the public force and the sanctioning power to eradicate institutional arbitrariness became imperative.
