Abstract

Prior, free, and informed consultation is a fundamental right of Indigenous peoples and nationalities, recognized by the Ecuadorian Constitution and international instruments such as ILO Convention 169 and the UN Declaration on the Rights of Indigenous Peoples. In this context, the research project entitled "The Right to Prior Consultation in Indigenous Communities of Ecuador: An Analysis of its Application Based on Constitutional Jurisprudence" was developed. The general objective was to analyze the non-application of the right to prior consultation in Indigenous communities of Ecuador, in light of constitutional jurisprudence and its effectiveness as a guarantee of participation and self-determination. To achieve this objective, the following specific objectives were established: to identify the violation of the rights of Indigenous communities due to the non-compliance with prior consultation; to determine the causes and consequences of the violation of collective rights due to the lack of prior consultation; and to study emblematic cases, determining the violation of collective rights. The study employed a mixed-methods approach, utilizing scientific, descriptive, inductive, deductive, and analytical-synthetic methods, and was descriptive, and explanatory. Techniques included surveys using questionnaires administered to forty people from the Shaime community, in Alto Nangaritza, Zamora Chinchipe province. The research results conclude that the effectiveness of free, prior and informed consultation depends on: clear and verifiable procedural rules, institutional strengthening, substantive community participation, and a gender and territorial focus.
